CA 1102 is a California Civil Code that was created in 1985
for Consumer Protection in Real Estate Transactions.
It defined a Standardized Document for Disclosure Statements
to help make sure the Seller did not omit important information.
It specifies delivery of the "Transfer Disclosure Statement" (TDS)
"prior to transfer of title" which pros know,
happens "oddly" at time of Contract Acceptance,
which is weeks or months prior to Payment and Deed Conveyance.
The Goal for CA 1102 was obviously to reduce
confusion and conflicts between Sellers and buyers.
That would have also reduce the need for
Real Estate Attorneys and Mediators State wide.
That's a win-win for all but the Legal Lobby and Crooked Brokers, right?
Such a law should have reduced the income Real Estate Attorneys and
Mediation Companies were making on conflict.
It also would have reduced the income going to insincere Brokers and Agents
willing to coach Buyers through less than sincere transactions.
Keep these two groups of "losers" in mind as this story unfolds,
because all of them did something EVIL that is
just coming into full light over THREE DECADES years later...
